Cohabitee Disputes
Cohabitee disputes regarding finances are far from straightforward. Division of the assets largely depends upon whether they are owned jointly or individually. Of particular importance is how any property is owned if it is owned jointly and, if the intention is for there to be unequal division, whether a formal document (a Declaration of Trust) was prepared at the time of purchase.
If there is no such document and one cohabitee wishes to claim a greater share of the property they will be reliant on showing that their financial contribution to the property justifies them claiming a greater share. Our Team will advise you as to the probable outcome and the practical solutions to disputes.
If you have any queries in this regard, please contact Kate Ryan or Joanna Pyne
